If I am following Inori right, the person recording the match wouldn't even know he or she was doing it.

We have to think further ahead, because when he or she is recording they could check their gunz folder, and im pretty sure they would know if they recorded or not, and if so they do, are they going to upload it if you follow inori's suggestion for a cw replay site? You don't want their folders to be filled with something they didn't even want.

Yes, there are no negatives to this, is there? Maybe hide the team chat since information from them might be private? Other than that:
spectators can watch to see a particular players' perspective
they can decide whether to report as well, if they spot something fishy
less hackers will cw knowing that they have a 1/4 chance of being recorded.

I can suggest it at our next developer meeting, thanks for the idea. I personally do not program, so there is probably a ton of variables I am not equating for, but there should be no problem at least talking about it.

you're still not following.
the player will HAVE to be recorded, forced by the server.
it won't be in his replay folder, only on fgunz.net/cw available for others to download...

It would probably not even use the current replay system. No file would be stored in the replay folder, and the upload would be automatic (while you are still in GunZ).

Basically you would replicate the replay function, and create a whole new function that just did this, otherwise you would have conflicts with other functions in the game.

yes im following what you're saying, so if its forced, and they wanted the replay for their own. They press the button they use to record, it wouldn't shut off huh? cause its for the site.

yes this way nobody will cry about people being unlegit and the actual unlegit won't clan war knowing they might be recorded.

The function would not be the current replay if this was ever implemented, we would make a replay function specifically for this, and just as Inori said, remove some information that users may not want others to see.

Simply put, it would not conflict with the current replay system at all.
