It doesn't look like he is abusing the fact he is lagging,
Looks like he didn't even know he went lagging.
Plus, the replay you provided is too short to determain anything.

According to our spiking / lagging rules, you must inform the user that he is spiking,
Because he maybe didn't actually know he was spiking / lagging.
