Did you take a screenshot of the vote kick? Since we can't see vote kicks in replays.
Also, I haven't found any previous reports on him for the same reason you reported him.

A screenshot is required in such cases, the only reason I'm willing to accept the replay is because the other person said "nah don't kick him". Since it's the first time he gets reported for such thing and he hasn't received any verbal warning (unlike you've stated above), he has received a verbal warning.
