GG 40 fps cannot be on the server it will dissapear to 0 , lowest fps that will stay is 60 , I am using 60 fps why cry about it :*

As long as the gpu is dropping frames you can still have 40fps.
Also, haven't you seen the fps limit option in the options?
Set it to 40, voila. 40 fps.
